Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the website and the self-hosted Android SMS gateway service (the "Service") operated by Your SMS Gateway ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access or use the Service.

1. Description of the Service

Your SMS Gateway provides open-source software and tools that allow users to turn an Android phone into a self-hosted SMS gateway. This enables sending and receiving SMS messages programmatically via a simple REST API.

Important Note: The Service is designed to be self-hosted. This means that once you download and install the software on your own server and Android device, all SMS data, API interactions, and message processing happen on your own infrastructure. We do not host, store, or process your SMS messages or personal data on our servers.

2. Accounts

When you create an account with us (e.g., to access documentation, download updates, or subscribe to newsletters), you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your account and password.
• Notify us immediately of any unauthorized use of your account.

You are solely responsible for any activity that occurs under your account.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal activity, including but not limited to spamming, sending unsolicited messages, harassment, or violating any applicable laws or regulations.
• Attempt to interfere with or disrupt the Service or any servers or networks connected to the Service.
• Use the Service to transmit any material that is harmful, abusive, defamatory, obscene, or otherwise objectionable.
• Attempt to reverse engineer, decompile, or disassemble any part of the software.
• Use the Service in any way that could damage, disable, overburden, or impair our website or infrastructure.

SMS Compliance: You are fully responsible for complying with all local, national, and international laws and regulations regarding SMS messaging (including anti-spam laws such as Bangladesh Telecommunication Regulatory Commission rules, TCPA in the US, GDPR in Europe, etc.). You must obtain proper consent from recipients before sending messages and provide clear opt-out mechanisms.

4. Self-Hosted Nature & No Liability for User Data

Since the Service is self-hosted:

• We do not have access to, control over, or responsibility for your SMS messages, contacts, API keys, or any other data processed on your server or device.
• You are solely responsible for the security, backup, and proper configuration of your self-hosted instance (including server security, HTTPS setup, firewall rules, etc.).
• We are not liable for any data loss, security breaches, unauthorized access, or misuse that occurs on your self-hosted setup.

5. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of Your SMS Gateway and its licensors.

The software is released under an open-source license (e.g., MIT License – check the specific license in the GitHub repository). You are free to use, modify, and distribute the software in accordance with the license terms.

6. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease.

7. Limitation of Liability

In no event shall Your SMS Gateway, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from the Service;
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party;
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
